I. Description of Smoke-Free Family
  1. The Smoke-Free Family program raises awareness for Quebec families to the dangers of second-hand smoke on health, particularly that of children, since they are more susceptible than adults to develop health problems when they are exposed to it.
  2. Smoke-Free Family informs families about second-hand smoke in order to raise their awareness, to ultimately nudge them into action by smoking outside their cars and houses. The program also offers information to smokers who wish to quit smoking.
  3. Registering to the “Smoke-Free Family contest presented by McNeil Consumer Healthcare, a division of Johnson & Johnson Inc.”, is free by going to SmokeFreeFamily.ca.

II. Eligibility
  1. To be eligible for the “Smoke-Free Family contest presented by McNeil Consumer Healthcare”, you must:
    1. Be duly registered to the “Smoke-Free Family contest presented by McNeil Consumer Healthcare”;
    2. Reside in Quebec, that is to have your permanent residence in Quebec, live there and usually live there;
    3. Be 18 years or older.
  2. The ACTI-MENU employees, representatives, agents or members of the eligibility committee and the people with whom they live are not eligible to participate in the drawings made in the context of Smoke-Free Family.

III. Registration
  1. Registration to the “Smoke-Free Family contest presented by McNeil Consumer Healthcare” takes place from October 15 2011 at noon [EST], to August 31 2012 at 11:59 pm [EST] (the “duration of the contest”).
  2. Any person interested in participating to the “Smoke-Free Family contest presented by McNeil Consumer Healthcare” must fill out and send in A SINGLE REGISTRATION FORM by August 31 2012 at 11:59 pm (EST), either in a Smoke-Free Family kiosk or by using the online registration form on the Smoke-Free Family website SmokeFreeFamily.ca. Every registration form shall have to be transmitted by August 31 2012 at 11:59 pm (EST) at the latest. If, because of technical problems, registration forms couldn’t be adequately integrated to the Smoke-Free Family website on August 31 2012, the organizers could make the decision to accept registration forms for an additional period. If this was the case, a special note would appear on the Smoke-Free Family’s website homepage.
  3. The registration form must be sent in by one of the following means:
    • By Internet, fill out and submit the online registration form on the Smoke-Free Family website at SmokeFreeFamily.ca
    • In a Smoke-Free Family kiosk, fill out the form and insert it into the assigned box.
  4. By submitting the registration form either through the Smoke-Free Family website or at a kiosk, the candidate declares having read and understood the rules of the “Smoke-Free Family contest presented by McNeil Consumer Healthcare” that they satisfy their conditions and are committed to respecting them.
  5. By submitting the registration form either through the Smoke-Free Family website or at a kiosk, the candidate confirms their name, age, place of residence, address, phone numbers and email. A few questions are also asked for statistical ends.

IV. Prizes

V. Distribution of the prizes and drawing
  1. Prizes will be distributed in the following way: the four (4) gift baskets (1 per drawing) shall be raffled away among all the participants in Quebec.
      The four (4) drawings will take place:
    • December 13, 2011 at 10:00, (for the people who will have participated between October 15 and November 30, 2011 inclusively)
    • March 13, 2012 at 10:00 (for the people who will have participated between December 1, 2011 and February 28, 2012 inclusively)
    • June 12, 2012 at 10:00 (for the people who will have participated between March 1 and May 31, 2012 inclusively)
    • September 11, 2012 at 10:00 (for the people who will have participated between June 1 and August 31, 2012 inclusively)
    The four (4) drawings will take place at 300, rue Léo-Pariseau, suite 1810, Montreal, Quebec.
  2. If the potential winner cannot be reached after three (3) days of attempts, at the rate of two (2) phone calls per day (72 hours after the first call), that there is no answer and no returned calls after a message has been left on their voice mail, the potential winner will not have the right to the prize. If necessary, the next potential winner on the list will be contacted. Whatever the reason, no waiting period will be allowed to surpass 72 hours from the first call.
  3. In the eventuality that a potential winner would not satisfy the terms of the current rules and regulations, they will be automatically disqualified and the prize shall be given to a new candidate chosen by a random drawing according to the same criteria of eligibility.
  4. ACTI-MENU and the Prevention Division of the Montreal Heart Institute are the initiators of the contest and ACTI-MENU is solely responsible for the organization of the draws, which are executed according to a rigorous process and supervised by a committee composed of in-house representatives involved in the production of Smoke-Free Family. This committee is named the “eligibility committee”.
  5. The prizes must be accepted as awarded and described in the present regulations for the “Smoke-Free Family contest presented by McNeil Consumer Healthcare”. They are not transferable and may not be replaced by other prizes, nor are they exchangeable, in whole or in part, for cash or other goods. ACTI-MENU reserves the right to substitute a prize of an equivalent value for a prize that cannot be awarded as described in the present regulations.
  6. The chances of winning depend on the number of registrations received during the registration period.

VI. Authority and responsibilities
  1. ACTI-MENU holds FINAL AUTHORITY in matters of judgment and decisions regarding the registration of the candidates, the evaluation of the eligibility of potential winners to the “Smoke-Free Family contest presented by McNeil Consumer Healthcare”, as well as distribution of the prizes.
  2. Subject to the application of An Act respecting lotteries, publicity contests and amusement machines relative to the “Smoke-Free Family contest presented by McNeil Consumer Healthcare”, any dispute with regard to the organisation or conduct of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux du Québec for resolution. A dispute with regard to the awarding of a prize may be submitted to the Régie des alcools, des courses et des jeux du Québec only for the purpose of an intervention to attempt to resolve such dispute.
  3. ACTI-MENU, its employees and consultants, and the organisers, partners, and sponsors of the “Smoke-Free Family contest presented by McNeil Consumer Healthcare” MAY NOT BE HELD RESPONSIBLE in the case of accident, loss, theft, or any other problem or costs related, directly or indirectly, to the acquisition or use of a prize.
  4. The applicable taxes under An Act Respecting Lotteries, Publicity Contests and Amusement Machines have been paid.
  5. The refusal to accept a prize frees ACTI-MENU from any obligation related to said prize, including its delivery.
  6. ACTI-MENU and its agents are not responsible for technical, mechanical, computer, telephone, telecommunications, distribution, or production errors and may cancel or withdraw the draw if such errors arise, without obligation and without prior notice, at its sole discretion, subject to authorization by the Régie des alcools, des courses et des jeux du Québec.
  7. ACTI-MENU is not responsible for damages to a user’s computer system subsequent to his registration to the contest or to the download of the information necessary to register for the contest.

VII. Confidentiality Policy

ACTI-MENU’S POLICY ON THE PROTECTION OF PERSONAL INFORMATION

This document explains the Policy on the protection of personal information as applied by ACTI-MENU, its employees and representatives.

Introduction
In its normal course of business, ACTI-MENU collects personal information about its employees, its clients and their employees, participants in its various campaigns and its subcontractors. All personal information collected respects the general laws and regulations that apply to confidentiality and/or is subject to ACTI-MENU’s policy for the protection of personal information. ACTI-MENU is committed to ensuring the accuracy, confidentiality, security and private nature of the personal information it collects by stringently applying its policy and ensuring that it is respected by all of its employees and representatives.

Responsibility
The directors of business units and departments are responsible for ensuring that the policy is respected and taking the appropriate measures to facilitate its application on a day-to-day basis. In cases where the policy is not respected, they will take appropriate measures to correct the situation.

Determining how the collected information will be used
At the time it collects personal information, ACTI-MENU will specify in a document or an agreement how the information will be used and will provide written notification to the people from whom the information is being collected. The collection of information is limited to the purposes for which it was authorized. Otherwise, ACTI-MENU will obtain additional consent as required.

Consent
ACTI-MENU will inform and obtain consent from all persons concerned before it collects, uses or transmits personal information, unless it is inappropriate to do so under applicable laws.

Limits on the information collected
ACTI-MENU will take measures to ensure that only information needed for the purpose identified will be collected. The personal information will not be transmitted or used for any other purpose other than that for which consent was obtained.

Subject to applicable laws, ACTI-MENU may keep personal information on file for as long as necessary for pre-established purposes, even if the person is no longer an employee, client or participant.

Accuracy
ACTI-MENU’s employees are required to inform the directors of business units or departments of any changes to information in their file. Clients, participants and subcontractors are also requested to provide any changes to information previously submitted to ACTI-MENU. ACTI-MENU will update personal information as soon as it is received from employees, clients, participants and subcontractors, when it is relevant to do so.

Security
Personal information is protected by security measures that are commensurate with the degree of sensitivity of the information. Security measures protect personal information against loss or theft and against unauthorized consultation, transmission, copying, use or modification.

The nature of the security measures will vary depending on the degree of sensitivity of the personal information, the quantity, distribution and format of the information, as well as how it is conserved. Various methods may be used, such as rendering the information anonymous, restricting access, applying password protection or any other means judged to be appropriate under the circumstances.

Transparency
This policy is distributed to all managers, administrators, employees and contributors and to any person who requests it.

Access to personal information
ACTI-MENU will inform anyone who inquires as to the existence of personal information how the information is used and the fact that it has been provided to third parties, and will allow them to consult it. It will be possible to confirm the accuracy and comprehensiveness of the information and to make corrections if required. Complaints will be handled according to the appropriate procedures and within a reasonable timeframe. This policy will be upgraded periodicall
